These Terms govern your use of the Website and our professional imaging services, including laser scanning/reality capture, 2D & 3D documentation, 360 virtual walkthroughs, and showcase media, as described on our Main Page. If you do not agree with these Terms, please do not use our Website or services.
 
1. Acceptance of Terms
By accessing the Website, submitting information via our Get a Quote Page, scheduling a consultation through our Cal.com booking system, or engaging our services, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are acting on behalf of an organization (e.g., as an architect, designer, permit expediter, contractor, property manager, or real estate professional), you represent that you have the authority to bind that organization to these Terms.
 
2. Services
As detailed on our Main Page, Avid Imaging provides the following professional imaging services to support architects, designers, permit expediters, contractors, property managers, and real estate professionals:
  • Laser Scanning / Reality Capture: Using terrestrial, mobile, and aerial laser scanning to generate millimeter-accurate 3D digital models for design, documentation, and project coordination.
  • 2D & 3D Documentation: Producing precise 2D floor plans, elevations, and 3D models from laser-scanned point clouds, delivered in formats such as CAD, Revit, SketchUp, MEP, RCP, millwork, or PDF, tailored to your specifications.
  • 360 Virtual Walkthroughs: Creating high-resolution, immersive 360° virtual tours for remote visualization, ideal for offsite viewing and complementing plan sets.
  • Showcase Media: Providing professional photography and video (stills and reels) to highlight completed projects.
Services are subject to availability and require a consultation and quote, which can be requested via our Get A Quote Page or by scheduling a phone call through our Cal.com booking system, using platforms such as Zoom, Google Meet, or Microsoft Teams.
 
3. Use of the Website
You agree to use the Website only for lawful purposes and in accordance with these Terms. Prohibited activities include:
  • Violating any applicable federal, state, or local laws or regulations.
  • Attempting to gain unauthorized access to our systems, data, or third-party platforms (e.g., Cal.com, Zoom, Google Meet, Microsoft Teams).
  • Uploading or transmitting harmful content, such as viruses or malware.
  • Reproducing, distributing, or modifying Website content without our express written permission.
 
4. Intellectual Property

Upon payment, clients may receive a limited, non-exclusive license to use the deliverables, as specified in the service agreement.
 
5. User Submissions
When you submit information through our Get a Quote Page (e.g., via the contact form requesting name, company name, email, phone, project address, square footage, building type, scope of work, industry, or project details) or through our Cal.com scheduling system (e.g., attendee phone number), you grant Avid Imaging a non-exclusive, worldwide, royalty-free license to use, store, and process that information to provide our services, respond to inquiries, or schedule consultations. By submitting the contact form, you agree to our Privacy Policy, as noted on the Get a Quote Page. You represent that all submitted information is accurate and that you have the right to share it.
 
6. Scheduling and Consultations
You may schedule a consultation via our Cal.com booking system, accessible through the Get a Quote Page, selecting options for Zoom, Google Meet, or Microsoft Teams. You are responsible for providing accurate contact information (e.g., attendee phone number) and ensuring availability for scheduled meetings. We reserve the right to reschedule or cancel consultations due to technical issues, scheduling conflicts, or other unforeseen circumstances. Avid Imaging is not responsible for technical issues related to third-party platforms (e.g., Cal.com, Zoom, Google Meet, Microsoft Teams).
 
7. Payments and Fees
Fees for services are provided in a transparent quote within one business day, as noted on our Get a Quote Page. Payments must be made in accordance with the terms outlined in the service agreement or quote. Failure to make timely payments may result in suspension or cancellation of services. Refunds, if applicable, will be handled according to the service agreement or applicable law. All pricing is fair and transparent, as described on our Main Page.
 
8. Privacy
Your use of the Website, including submissions via the contact form or Cal.com scheduling system, is subject to our Privacy Policy, available on the Get a Quote Page. Please review it to understand how we collect, use, and protect your information.
 
9. Limitation of Liability
To the fullest extent permitted by law, Avid Imaging, its affiliates, and its employees shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Website, scheduling system, or services, including but not limited to loss of data, profits, or business opportunities. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.
The Website and services are provided on an “as-is” and “as-available” basis. We do not guarantee that the Website, third-party platforms (e.g., Cal.com, Zoom, Google Meet, Microsoft Teams), or services will be error-free, secure, or uninterrupted. We are not liable for delays or inaccuracies caused by client-provided information (e.g., incorrect project details or site access issues).
 
10. Indemnification
You agree to indemnify and hold harmless Avid Imaging, its affiliates, and its employees from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Website, violation of these Terms, or infringement of any third-party rights, including issues arising from inaccurate information provided via the contact form or scheduling system.
 
11. Project Coordination and Site Access
As outlined on our Main Page under “Our Process,” we coordinate with your site manager and tenants to ensure access and readiness for on-site scanning. You are responsible for providing accurate project details (e.g., project address, square footage, building type, scope of work) and ensuring site access. Delays or additional costs due to lack of access or inaccurate information may result in adjusted timelines or fees, as specified in the service agreement.
 
12. Termination
We may suspend or terminate your access to the Website or services at our discretion, with or without notice, if you violate these Terms, fail to provide payment, or engage in conduct we deem harmful to our business or other users. Upon termination, your right to use the Website and any deliverables will cease immediately, subject to the terms of the service agreement.
 
13. Changes to These Terms
We may update these Terms periodically, with changes posted on the Website and marked with the “Last Updated” date. Your continued use of the Website or services constitutes acceptance of the updated Terms.
 
14. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of laws principles. Any disputes arising from these Terms or your use of the Website or services shall be resolved in the state or federal courts located in Ocean County, New Jersey.
